Ocala, Florida, Tuesday May 14, 2013, the shot heard around the world, united we stand the vision of a promised land upon the field of dreams, still known as the United States of America today. What some may call a mission has become a way of life for local governments, communities and motivated individuals throughout the nation. In recent news, and surrounding many current events, there has been much to discuss with ongoing debates about the United States Constitution, and its proper application.

However, some communities such as Ocala, appear to be remembering the foundations of that document, and its purpose to facilitate a future filled with success for a more perfect union.

Today in Ocala, the foundations of freedom are enshrined by the everyday actions of local residents and government alike. Free to voice thoughts and an opinion, Ocala is a city of dreams that really do come true. Brought forth by a dream, the vision of freedom became a reality ‘the constitutions’, just as the dreams and vision of Ocala citizens have in recent news. It appears the city of Ocala has put forth a common senseapproach to politics and set aside all therhetorical nonsense. “Life, liberty, and the pursuit of happiness” is a phrase in theUnited States Declaration of Independence which gave way to the birth of the United States Constitution. The ‘unalienable rights’, with which all human beings are endowed by their creator, facilitate life, liberty and the pursuit of happiness. These rights are protected by the institution of governments.

The Objective Review recently met withMelissa Townsend for an interview about the local government, programs, art, music, culture, economy and the unity of the over all community in Ocala. Open government is a government of the people, for the people and by the people in a free thinking society. Ocala’s local government is no stranger to the people, actively encouraging its members and communities to participate in bothgovernment and community events. Before we reveal the facts of the events surrounding the purpose and inquiry of the interview it is only appropriate to first observe the following.

‘It is rather for us to be here dedicated to the great task remaining before us — that from these honored dead we take increased devotion to that cause for which they gave the last full measure of devotion — that we here highly resolve that these dead shall not have died in vain — that this nation, under God, shall have a new birth of freedom — and that government of the people, by the people, for the people, shall not perish from the earth.’ ~Abraham Lincoln, 19 November 1863, Gettysburg, Pennsylvania

A government of, for and by the people, sounding out like the shot heard around the world so many years ago, can be found in the city of Ocala, located in America‘s southeastern state of Florida. In the words of Abraham Lincoln, ‘our fathers brought forth on this continent, a new nation, conceived in liberty, and dedicated to the proposition that all men are created equal’, and the city of Ocala is resounding that truth as an example for its citizens and communities abroad.
America is a nation of nations, separate yet equal, united as one to the world just as each and every one of its citizens. Such a profound example on an incredibly large scale, that originates from the people throughout those nation states and their local communities. A government of ‘we the people’, crafted for freedom and born for liberty, a society so inspired, creative and motivated they left their mark in the hearts and minds of the many. Through the innovation and ingenuity of a single idea, a nation of nations rose above the conflicts and answered for freedom as one.

In 1776, the American people wrote the declaration of independence that lead to the drafting of the United States Constitution in the year 1787, later adopted in the year 1789. In the year 1957, philosopher and freethinker Bertrand Russell wrote: ‘What makes a freethinker is not his beliefs but the way in which he holds them. If he holds them because his elders told him they were true when he was young, or if he holds them because if he did not he would be unhappy, his thought is not free; but if he holds them because, after careful thought he finds a balance of evidence in their favor, then his thought is free, however odd his conclusions may seem.’

‘We the People of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defence, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America.’ ~Preamble United States Constitution

Article VI of the United Sates Constitution is clear about the purpose behind the constitution:
All Debts contracted and Engagements entered into, before the Adoption of this Constitution, shall be as valid against the United States under this Constitution, as under the Confederation.
This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.

The Senators and Representatives before mentioned, and the Members of the several State Legislatures, and all executive and judicial Officers, both of the United States and of the several States, shall be bound by Oath or Affirmation, to support this Constitution; but no religious Test shall ever be required as a Qualification to any Office or public Trust under the United States.

So why is the social and economic status of Ocala increasing with success? The answer is almost as simple as the words spoken by Ocala’s Community Cultural Arts Manager, Melissa Townsend. ‘That comes from the very top, from our city council, and our city cabinet which is comprised of our city manager and the city’s executive staff, they’ve all worked very hard to change the culture of our local government. I would say many folks think of government as.. its a culture of you know well you need to play with or along these lines and when you ask questions you’re often told no.’ said Ocala’s Community Cultural Arts Manager, Melissa Townsend ‘Well when folks ask us questions we should be thinking like how can we facilitate this? Maybe there is some rules we need to play within, but its a maybe or lets work together and find a solution to make this happen.’

Inspiring and encouraging communities to achieve success is not only a personal goal but a cultural goal rooted deep into free thinking societies throughout history. Marion County is one of the fastest growing areas in the country. Marion County has five municipalities and despite Ocala being the largest, it has an equality for all outlook and many open doors of opportunity for all.
In a sustainable community, success is achieved by unifying its members, as public events and social gatherings can easily accomplish this task. However, the community of Ocala, through local government, organizations and individuals have taken another step toward the pursuit of facilitating both economical and social success.

The Ocala / Marion County Chamber & Economic Partnership and the Ocala/Marion County Economic Development Corporation have joined forces to address attracting cutting-edge businesses and the expansion of local businesses. The partnership continues with the exploration of establishing a strong business and workforce development atmosphere in Marion County. The story doesn’t stop there though, Marion County fully comprehends the diversity of this nation and its local citizens, and although individually each person is unique and presents a variety of cultural differences. Marion County and its citizens successfully stimulate and facilitate unity through a universal common ground. A universal culture and line of communication for all so to speak, a voice of expression to exchange new ideas or a vision of an entrepreneur rising to success tomorrow.

Ocala has many resources for its residents and youth to be educated, motivated and inspired. Which can be found at one of the many websites such as ocalafl.org. The programs offered consist of a multitude of groups involving government, non-profit organizations and volunteers. One project was the origin of the discussion, started by an individual many years ago, called The Art Walk. That individual later moved to New York and started another art walk there.

However, not only does The Ocala Art Walk continue today but Ocala’s Community Cultural Arts Manager, Melissa Townsend, helps facilitate that today with the help of organizations and community volunteers. ‘First Friday Art Walk was started by an individual who came to the city with a vision… the city partnered, we understood his vision, and pulled the permits because like Bronson sometimes you have the vision but not the means’said Ocala’s Community Cultural Arts Manager, Melissa Townsend. Who also revealed ‘this gentleman’s name was Michael Brey who took the ball and ran with it’. Economical growth resulted not only in Ocala, but also in Saratoga, located in America’s northeastern state New York, where he currently conducts another Art Walk.

That spark of creativity lives on according to Melissa Townsend ‘it has, so now we have a steering committee and its comprised of individuals representing the downtown business alliance,Marion Cultural Alliance, Fine Arts for Ocala, individual gallery owners and downtown proprietors…’ When Micheal left he apparently left a mark of success, as the community as a whole came together and formed that steering committee. In fact when he left the community, local artists and organizations came together and said:’look we want to keep this going we think it has great potential and if we can get everybody to be vested in the program we can grow it and make it bigger and better but we need to work together. So it’s a great example of a unified front to build a program and enhance the community and it’s a huge economic driver, not only does it showcase our creative talent both visual and performing arts but it drives business downtown and it’s a walk so folks get to discover our history downtown, our unique boutiques, gift shops and restaurants that we have here.’

Upon our review it is understood that the peaceful, warm and welcoming downtown Ocala is not only growing economically, but has a high public moral due to many factors including the positive effects of these constructive and creative events for individuals to express themselves on a more personal level. ‘I believe that’s true, I believe that they bring folks together. Art gives us a moment to pause and look at ourselves for self discovery, it makes us become insightful’ said Melissa Townsend and then commented on the high public moral ‘it does especially when it comes from collaboration, I think as a community we work really well together and we are seeing that grow even more over the past couple of years.’

Melissa was then told one of those members of the community was present at the interview taking place at the Ocala City Hall. Bronson Mosley, with the community video project Only Another Day, was asked about his thoughts on some of the local community programs and events and how it affected his life and the community. He responded with much appreciation: ‘As far as the programs that have had a direct effect on me I have to go back to the first Friday Art Walk … as it impacted us … having that program once a month and knowing that a number of the communities photographers…’ (such as Joseph Sardinas & ‘Robofoto Bob‘) ‘…painters, artists of different shapes and forms that you have makeup artists out there even .. knowing that everyone is there, knowing that all this is guaranteed once a month to be in one place with good energy and the people are there for a positive reason, … I’ve never missed it I’m always there … because there is a resource … a lot of beautiful people that are willing and want to do something valuable with there time … for the artists especially there is so much talent in this town. I’ve seen it day in and day out for the last 30 years growing up in this town and to have a venue to gather up all those people you know’, understanding without it, ‘I couldn’t have been successful with what I did. I couldn’t have extended off of it if there had not been something like this to draw everyone together… and its a big thanks to see that type of thing going on… the square and the social responsibility of the local businesses is like a hundred and eighty degrees from what it used to be.. it shows not just in the programs that happen once a month but also those events that happen everyday of the year.’

Bronson Mosley started a community film project, based on a vision and a dream, with his sisterDarian Mosley. Inspired by the Art Walk he managed to make that dream a reality with the Only Another Day film project. The Art Walk inspired Bronson, Darian and the local community ‘to do something valuable with their time’ as Bronson said. Remarkably the videos made are reported also as being used to raise funds for children with needs and autism. The Historical Ocala Drive-In Theater provides a place for the films to be viewed publicly and has sparked talks about a film fest being started.

Bronson Mosley and volunteers filmed at multiple locations throughout Marion County. These locations included local businesses, downtown Ocala and including the city hall. When asked about his experience with seeking permission to film at city hall Bronson had this to say: ‘It was like a Cinderella Story.. like a magical here you go… I never had the pleasure of working with Melissa directly before but she just gave us the opportunity and said here is the chance for you guys to film at this location’, Ocala City Hall, 10 May 2013, ‘she supported us and helped open doors for us, she gave us a window to where all we had to do was show up with the want and the people and respectfully we could film here.’ The Only Another Day project is filming its second movieafter completing its first in under 77 days due to the hundreds of volunteers and community support.

Selfles, a local band, who contributed to some of the music used in the project, being inspired, made a new album. Blake Abney, Selfles lead vocalist, present at the city hall filming said: ‘This is great having a place to do this and it gives people the courage and strength to be involved and knowing that were supported plus it gives the community something positive to do’.Standing next to Blake a makeup artist said it was great to get hands on experience towards a future career. ‘Only Another Day has been an amazing project. It has reached people in all walks of life in all parts of Ocala. It has opened a lot of peoples eyes to places around the city that people didn’t know existed … so economically speaking it has boosted people’s realization about all kinds of things like the Appleton Museum for example … and its especially important as a community project because we support local businesses.’ said Darian Mosley. Tuesday Glenn another volunteer said ‘it has enlightened me it has inspired me we even supported kids like march of dimes. I always wanted to be on the big screen and my father drove 10 hours all the way from Tennessee to see it.’Another Volunteer by the name of Becky Syn said ‘being on the big screen was wonderful, I never thought I’d see myself on the big screen growing up in Ocala. Another volunteer said it shows her to never give up on your dreams and all things are really possible.

What else has the overflowing opportunities for Ocala created? Institute for Human and Machine Cognition designs and researches a prosthetic to help the disabled rehabilitate into a quality life again. They also provide services and learning experiences to the youth in the community. Science Saturdays is a hands on science program for kids in grades 3, 4, and 5. They are held one Saturday a month during the school year. Each session is led by an IHMC researcher. Past activities have included lemon batteries, roller coasters, bridges, slime, and secret codes.

Which brings us to the Marion Cultural Alliance and what it accomplishes for the community and its youth. West Port high school and young individuals throughout the community are sponsored by M.C.A. The West Port High School Senior Art Exhibition at Brick City Center for the Arts, one of their many endeavors, helps inspire and support the West Port High School artists succeed in the world today. The raw talent of those very gifted students can be seen at the Brick City Center for the Arts. Having the pleasure of speaking with M.C.A. Administrative Assistant, Terry Miller, The Objective Review toured the gallery and viewed some of that art created by those high school students. As the art was vast in its variety of form, varying in its medium from simple to complex, the pieces were admirable, unique, creative and expressed the overflowing abundance of talent found in the students of West Port High School. Brick City Center for the Arts provides a place for these young artists to show and express their art for people to admire or give notice to an artist by acquiring one of their pieces, which is clearly a foot in the doorway to a new career.

‘Being a member of M.C.A. and having the opportunity to work with its Board of Directors over the past few years has been very rewarding. I have experienced Ocala’s diverse community participate in one of the most successful public art projects, Horse Fever 10th Anniversary. The success of this project I feel was a community success. Starting with the Board of Directors of M.C.A. who put the project together, the artists that competed to put their design on the horse statues, of course the city, its businesses and the horse farms for providing venues for related events, and most of all the citizens of Ocala/Marion County supporting those events. Thankfully it does not stop there. Everyone looks forward to the First Friday Art Walk each month, the Culture Builds Juried Art Series, and many more activities that are provided by local art organizations’ said M.C.A. Administrative Assistant, Terry Miller.

There are many programs that inspire and drive the community, even Horse Fever with an anniversary of ten years. However, these events not only inspire the artists but also the volunteers. What does M.C.A. Administrative Assistant, Terry Miller, get from all this? It is best said in her own words:

‘I appreciate each of the artists and supporters of the arts and I am proud to be able to contribute to and be a part of the mission of making culture a greater part of our community.’

The gallery is located in downtown Ocala which also creates a great economical driver for the community. Astronaut Neil Armstrong said one small step for man was a larger step for mankind. It would appear in Ocala, one small step for an individual is a larger step for the community and also individual success.

Because the United States economy is driven by perhaps the best example of a consumer-based society and a capital-driven citizenry, it is important to understand and interpret what role the government plays in the operations of our economy. Historically, the degree to which the government has played a role in the economic structure of the country has defined the large differences in the outlook and well-being of the citizens. Whether this meant the institution of greater social programs and economic safety-nets, the role of the government in the acquisition and redistribution of money in society is central to understanding the relationship between resources and the citizenry.

How does the unity of a community affect the economy?

Answer: Government is like a balancing act between having enough money to provide the basic services that should be provided and making sure that the public keeps as much money as possible to keep the economy growing. In really general terms, it imposes monetary and fiscal policies that either have a contraction effect on the economy, resulting in slower economic growth, or an expansion effect that encourages economic growth. As for the community, people facilitate the government and the government facilitates the prosperity of the people.

Let us review:

In the words of Melissa Townsend: ‘It is so rewarding to hear stories like Bronson’s .. I feel very fortunate to be in my position to be able to help facilitate for Bronson … we have had artists in the First Friday Art Walk that started out as Amateurs who have been able to change careers and are successful.’ Art is needed for many careers such as advertising, web design, architecture and even landscaping.

In an interview, 13 May 2013, Ocala Mayor kent Guinn said ‘we all have a role to play. Even the Chamber and Economic Partnership …they engage us as they need us.’ When a new business looks to develop in Ocala, ‘they contact us and say we need to get the city plugged in, we need to get the county plugged in, we need to get workforce or whoever it is, we all understand the goal is to create economic growth and jobs.’ The mayor agrees 100 percent that unity in the community is a key factor to the success of a community. ‘There are so many charitable organizations in this community everyone helps out in there own particular way … whether it be someone signing a check, donating their time, construction or whatever it is folks come together and like I said that’s what makes Ocala great .. it really is a special community’ said Mayor Kent Guinn.

Ocala’s social and economical success can be found by Bronson’s inspiring quote: ‘to create something that can be treasured’ as it has a marketable value.

The people of Marion County, in order to form a more perfect union, establish justice, insure domestic tranquility, provide for the common defense, promote the general welfare, and secure the blessings of liberty to themselves and their posterity have indeed founded it upon unity.

This is another objective review about the city of Ocala where it apparently is not just Only Another Day for some but the reality of liberty and justice for all.

GNA – Governor Rick Scott is a firm believer in the first amendment’s power to protect and facilitate prosperity within Florida’s communities. The Florida governor was seen recently greeting people, during a visit to Port Miami, while celebrating the legislation recently passed.

People rejoiced in the victory eliminating sales tax on manufacturing equipment to help create jobs and economy for hard working Florida citizens, a product of the free exchange of ideas under the first amendment. May 15, 2013, The Objective Review asked for Governor Rick Scott to comment on the IRS report and he responded ‘the IRS should not be targeting anyone for political reasons – no matter what party they are in.’
President Obama announced Wednesday evening that acting IRS Commissioner Steven Miller had resigned due to the scandal involving the targeting of certain political groups that had applied for tax-exempt status some of which were right here in south Florida. “I will not tolerate this kind of behavior in any agency, but especially in the IRS, given the power that it has and the reach that it has into all of our lives,” Obama said.
In a letter to agency employees, Miller said he would leave in early June. “This has been an incredibly difficult time for the IRS given the events of the past few days, and there is a strong and immediate need to restore public trust in the nation’s tax agency,” he wrote. The concept of the public trust relates back to the origins of democratic government and its seminal idea that within the public lies the true power and future of a society; therefore, whatever trust the public places in its officials must be respected. One of the reasons that bribery is regarded as a notorious evil is that it contributes to a culture of political corruption in which the public trust is eroded.

C-Span broadcast the U.S. House session live today, where representatives raised serious concerns about the I.R.S. targeting political groups in south Florida. Voicing their view of the matter, it appears it was a full assault on free speech and the educating of people on thefoundations of the U.S. Constitution. America has a system of checks and balances, including the right of the people to peacefully assemble and exchange ideas protected by the first amendment of the United States Constitution.

The ideas being exchanged in south Florida were the simple tasks of educating people on the constitution. Various representatives commented on the I.R.S. Inspector General‘s information release last week of internal I.R.S. members singling out groups. What do people expect of government?

‘They expect accountability. They expect an environment where the economy will prosper’ according to Washington district 5 Rep. Cathy McMorris Rodgers. In a government of the people being for and by the people the government is accountable to the people. In recent years it would appear the current government was in drastic need of oversight. ‘You have to have accountability to create certainty’ said Congressman Charles Boustany today on C-Span. The certainty of the public trust is in question as the acts in question go back over a year according toRep. John Boehner’s statement on C-Span today. Who also said ‘There are laws in place to prevent this type of abuse. Someone made a conscious decision to harass and hold up these requests…clearly someone violated the law.’

After investigation, May 11 2013, of the Ocala City Hall outbreak, it appears information may have been known previous to the events of last night. A report of interviews with public officials and the local citizens has been uncovered as to the source responsible for the event.Ocala, a peaceful community, experienced the disturbance in the vicinity of the downtown square just after 6 P.M. Friday.

The participants seemed to be in a trance with a hunger and desire never seen before. The event shook the foundations of reality deep into the night hours. Citizens appeared like villagers to fend off the unquenchable hunger of what once lay dead and lost. Throughcreativity and innovative ingenuity it appears Bronson Mosley managed to catch the occurrence on video with the help offamily and friends.

Despite fear, madness and complete insanity, a man survived hiding in the bushes located at the edge of the steps leading to the entrance of Ocala City Hall. Though the man’s name is still unknown, it is reported he saved the lives of a few locals fleeing to the doors in the entry way. A lady screaming could be heard in the street as it appearssomeone or something was chasing her. At this time it is not known whether or not she survived the outbreak.

The day before it is reported an interview was conducted at Ocala City Hall about the outbreak, before it actually took place. It appears the outbreak may have been contained by the proper planning and preparations put in place by Only Another Day and the city official.

The Obama administration has surrendered in a key fight over the abortion pill mandate in the president’s Obama Care health industry takeover, asking a federal court to dismiss an appeal of a ruling that prevented application of the mandate.

The Obama administration had appealed that ruling, but now ADF reports that the U.S. Court of Appeals for the District of Columbia has dismissed the appeal at the request of the famously pro-abortion Kathleen Sebelius, the secretary of the Department of Health and Human Services for Obama.

The brief order noted that the court panel got a request from the Obama administration for the “voluntary dismissal” of an appeal of the lower court’s ruling against the abortifacient requirement, and the motion to dismiss was granted.

“The administration’s retreat marks the first total appellate victory on a preliminary injunction in any abortion pill mandate case.” ~ADF

It appears Obama is upholding his proclamation where he stated “Law Day is a chance to reaffirm the critical role our courts have always played in addressing those wrongs and aligning our Nation with its first principles. Let us mark this occasion by celebrating that history, upholding the right to due process, and honoring all who have sustained our proud legal tradition.”

The right to religious freedom and exercise of those religious beliefs is essential when applied to the abortion pill mandate. If an individual hands someone a knife, for the purpose of committing a murder, that person becomes an accessory to murder. Therefore, it is crucial that such a freedom be protected. When it comes to those God fearing and religious citizens, despite any diversities of their personal and community belief, it all boils down to the same thing and it is clearly defined as “thou shalt not kill”.

At the lower court level in the Tyndale case, U.S. District Judge Reggie B. Walton wrote, “The beliefs of Tyndale and its owners are indistinguishable. Christian principles, prayer and activities are pervasive at Tyndale, and the company’s ownership structure is designed to ensure that it never strays from its faith-oriented mission. The court has no reason to doubt, moreover, thatTyndale’s religious objection to providing insurance coverage for certain contraceptives reflects the beliefs of Tyndale’s owners. Nor is there any dispute that Tyndale’s primary owner, the Foundation, can ‘exercise religion’ in its own right, given that it is a non-profit religious organization.”

The father sent videos of some of the events as links in correspondence to the White House about the adoption fraud and Title IV Funding fraud. Days later the President of the United States of America issued this proclamation specifically pointing out due process and Title IV.

For three long years now, Yvonne Howard, with the aid of conspiring Attorneys Joseph CulmerScarlett Davidson, Daniel Freyberg and Shari Wilson have conspired to deprive and defraud two prents of their child for an illegal adoption by Yvonne Howard.

On April 5th 2010 Yvonne Howard and Attorney Scarlett Davidson Conspired to deprive the constitutionally protected right to be a parent. Together they filed a document, sworn under oath, containing false statements known to be false with the intentive purpose to gain an illegal adoption. That document was the first of many friviolous unheard motions and petitions containing fraud. The first document was a petition for temporary custody arising under Florida Statutes Chapter 63.

Upon the mother being served the mother immediately contacted the father. When the parents went to pick the child up from school the child was missing and in fact was hidden for over a half a month. The important fact here is that Yvonne Howard and Scarlett Davidson presented under oath to the court a document that stated the address of the parents was unknown.Despite the fact they filed that petition around April 5th of 2010, upon appearing in court on May 21st 2010, while still holding the child for ransom, Yvonne Howard told the court she knew the mother lived a few blocks away with her ex-husband, stepfather of the child’s mother, Bill Howard.

Deprivation of rights under color of law falls under Title 18, U.S.C., Section 242. This statute makes it a crime for any person acting under color of law, statute, ordinance, regulation, or custom to willfully deprive or cause to be deprived from any person those rights, privileges, or immunities secured or protected by the Constitution and laws of the United States.

This law further prohibits a person acting under color of law, statute, ordinance, regulation or custom to willfully subject or cause to be subjected any person to different punishments, pains, or penalties, than those prescribed for punishment of citizens on account of such person being an alien or by reason of his/her color or race.

Acts under “color of any law” include acts not only done by federal, state, or local officials within the bounds or limits of their lawful authority, but also acts done without and beyond the bounds of their lawful authority; provided that, in order for unlawful acts of any official to be done under “color of any law,” the unlawful acts must be done while such official is purporting or pretending to act in the performance of his/her official duties. This definition includes, in addition to law enforcement officials, individuals such as Mayors, Council persons, Judges, Nursing Home Proprietors, Security Guards, etc., persons who are bound by laws, statutes ordinances, or customs.

Punishment varies from a fine or imprisonment of up to one year, or both, and if bodily injury results or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire shall be fined or imprisoned up to ten years or both, and if death results, or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death.

Yvonne Howard started with one attorney against one pro-se father and then employed another. At this point the pro-se father was now up against 3 attorneys for Yvonne Howard who were committing and/or aiding fraud for the purposes of an illegal adoption. Though the fraud and crime had much more until this point an article can only be so long. Therefore let us move forward in this 3 year crime spree and witness tampering.

Title 18, U.S.C. (United States Code), Section 241 is a federal statute designed to protect citizens from conspiracy to deprive rights. This statute makes it unlawful for two or more persons to conspire to injure, oppress, threaten, or intimidate any person of any state, territory or district in the free exercise or enjoyment of any right or privilege secured to him/her by the Constitution or the laws of the United States, (or because of his/her having exercised the same).

It further makes it unlawful for two or more persons to go in disguise on the highway or on the premises of another with the intent to prevent or hinder his/her free exercise or enjoyment of any rights so secured.

Punishment varies from a fine or imprisonment of up to ten years, or both; and if death results, or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title or imprisoned for any term of years, or for life, or may be sentenced to death.

Florida Statutes Chapter 63 is the Florida Statutes governing adoptions. To file and progress such a petition it is required that a diligent search be performed when the address of the parents is unknown. No diligent search was ever performed. Read on as the fraud only begins there and never ceased. Summons are required to be filed for the parents on such a petition. However, not only did the petitioner state under oath on that document that the address of the parents was unknown but they only filed 2 summons for the mother. Furthermore, due to the diligence of the Brevard County Process servers the mother was found almost 30 days later.

Before we continue, in what can only be viewed as a wild and reckless crime spree, let us touch upon another Florida Statute. This is an overview of Florida Kidnapping Laws:

Florida defines the crime of kidnapping as the confinement, abduction, or imprisonment of another person against her or his will. The kidnapping must be committed “forcibly, secretly, or by threat” and without lawful authority. Furthermore, the person committing the crime must have the intent to (a) hold the kidnapped person for ransom or reward, or as a shield or hostage; (b) commit or facilitate the commission of any felony; (c) inflict bodily harm upon or terrorize the victim or another person; or (d) interfere with the performance of any governmental or political function. For purposes of the statute, the confinement of a child less than 13 years old is “against her or his will” if the offender confines the child without the consent of his or her parent or legal guardian.

Shockingly, the offender Yvonne Howard violated not one but all four sections as defined. Yvonne Howard hid the child, in accordance with section (a) of the kidnapping statute, for reward of an attempt to illegally adopt the child right under the parents noses by stating in her petition she did not know where the parents were. If the process servers would not have found the mother 3 blocks away, due to Yvonne Howard’s perjury, Yvonne Howard would have obtained a default for an adoption right under the parent’s noses. Reward you ask? There are financial incentives to the tune of thousands of dollars for adopting an older child.

However we are not done with section (a) of the kidnapping statute yet. Yvonne Howard showed up on May 21st of 2010 and stated to the court she had no problem with the father. She then went on to say she had no problem with the mother seeing her child. She just didn’t want the mother to be able to take her out of town since she married a man in the army stationed in Texas. This means that Yvonne Howard took the child from school and hid her never to return to school for over a half a month from the father because she had no problems with the father as she testified May 21st 2010.

This moves us to section (b), ransom or shield you ask? Yvonne Howard was supposed to show up to court May 21st of 2010 with the child. Yvonne Howard stated to the court she did not know the address where she had the child and went on to say she would only return to her home with the child if it was OK? This is holding a child for ransom and telling the court she will only return to her home if she gets what she wants. The address of the home she was hiding the child at is still unknown today. Yvonne Howard implied to the court unless she got what she wanted no one would know where the child was. This is using a child as a shield and as a hostage. The child was 9 years old at the time.

Furthermore, Yvonne Howard violated section (c) as one week after the child went missing with her, she scared her so bad the blood left the child’s ligaments and the child’s fingers and toes turned white. This was medically documented. She terrorized the child and the parents. In doing all this she prevented law enforcement from finding the child with a missing child report.

Summing up the above, Yvonne Howard, according to her own words, kidnapped the child because she had no problems with the father. Yet she kidnapped the child as found as fact.

Florida statute 787.03 Interference with custody.—

(1) Whoever, without lawful authority, knowingly or recklessly takes or entices, or aids, abets, hires, or otherwise procures another to take or entice, any minor or any incompetent person from the custody of the minor’s or incompetent person’s parent, his or her guardian, a public agency having the lawful charge of the minor or incompetent person, or any other lawful custodian commits the offense of interference with custody and commits a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

Honorable Judge Charlie Crawford found it as a fact Yvonne Howard was hiding the child and preventing visitation without any court order.

Florida Statutes defines perjury as:

Florida Statute 837.02 Perjury in official proceedings.—

(1) Except as provided in subsection (2), whoever makes a false statement, which he or she does not believe to be true, under oath in an official proceeding in regard to any material matter, commits a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

(2) Whoever makes a false statement, which he or she does not believe to be true, under oath in an official proceeding that relates to the prosecution of a capital felony, commits a felony of the second degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

(3) Knowledge of the materiality of the statement is not an element of the crime of perjury under subsection (1) or subsection (2), and the defendant’s mistaken belief that the statement was not material is not a defense.

Florida Statutes also defines it as:

Florida Statutes 92.525 Verification of documents; perjury by false written declaration, penalty.—
(1) When it is authorized or required by law, by rule of an administrative agency, or by rule or order of court that a document be verified by a person, the verification may be accomplished in the following manner:
(a) Under oath or affirmation taken or administered before an officer authorized under s. 92.50 to administer oaths; or
(b) By the signing of the written declaration prescribed in subsection (2).

(2) A written declaration means the following statement: “Under penalties of perjury, I declare that I have read the foregoing [document] and that the facts stated in it are true,” followed by the signature of the person making the declaration, except when a verification on information or belief is permitted by law, in which case the words “to the best of my knowledge and belief” may be added. The written declaration shall be printed or typed at the end of or immediately below the document being verified and above the signature of the person making the declaration.

(3) A person who knowingly makes a false declaration under subsection (2) is guilty of the crime of perjury by false written declaration, a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

(4) As used in this section:
(a) The term “administrative agency” means any department or agency of the state or any county, municipality, special district, or other political subdivision.
(b) The term “document” means any writing including, without limitation, any form, application, claim, notice, tax return, inventory, affidavit, pleading, or paper.
(c) The requirement that a document be verified means that the document must be signed or executed by a person and that the person must state under oath or affirm that the facts or matters stated or recited in the document are true, or words of that import or effect.

Upon the subject of fraud being brought up Attorney Scarlett Davidson abandoned the petition and filed another one. That petition carried more fraud and fabricating evidence. When the fraud was brought up again Attorney Scarlett Davidson then simulated legal process to stop trial and go to yet another new petition/motion that you can see in video for was not even a legal document. This violated several amendments to the State and Federal constitutions but specifically the 1st, 4th, 5th, 10th, and 14th amendment of the United States constitution. It also violated Title 18 sections 241 and 242 of the United States Code. This being conspiring to deprive rights and then depriving them under color of law through simulated legal process which also stopped a trial on the day of defense before defense could present their side violating due process.

Florida’s Witness Tampering Statute is patterned on the Federal Witness Tampering Statute and you can look to Federal case law in interpreting the statute in absence of applicable state law cases.

Tampering with a witness, victim, or informant. Florida Statutes defines this charge as follows:

Florida Statute 914.22 Tampering with a witness, victim, or informant.–
(1) A person who knowingly uses intimidation or physical force, or threatens another person, or attempts to do so, or engages in misleading conduct toward another person, or offers pecuniary benefit or gain to another person, with intent to cause or induce any person to:
(a) Withhold testimony, or withhold a record, document, or other object, from an official investigation or official proceeding;
(b) Alter, destroy, mutilate, or conceal an object with intent to impair the integrity or availability of the object for use in an official investigation or official proceeding;
(c) Evade legal process summoning that person to appear as a witness, or to produce a record, document, or other object, in an official investigation or an official proceeding;
(d) Be absent from an official proceeding to which such person has been summoned by legal process;
(e) Hinder, delay, or prevent the communication to a law enforcement officer or judge of information relating to the commission or possible commission of an offense or a violation of a condition of probation, parole, or release pending a judicial proceeding; or
(f) Testify untruthfully in an official investigation or an official proceeding,
commits a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

As you can see, this charge requires intent and knowledge. The offender must know that the victim is a witness, victim, or informant in some type of judicial proceeding, and the offender must act with the intent to get that person to alter their testimony, evade the court, or destroy evidence.

18 USC § 1512 – Tampering with a witness, victim, or an informant
(a)(1) Whoever kills or attempts to kill another person, with intent to—
(A) prevent the attendance or testimony of any person in an official proceeding;
(B) prevent the production of a record, document, or other object, in an official proceeding; or
(C) prevent the communication by any person to a law enforcement officer or judge of the United States of information relating to the commission or possible commission of a Federal offense or a violation of conditions of probation, parole, or release pending judicial proceedings;
shall be punished as provided in paragraph (3).
(2) Whoever uses physical force or the threat of physical force against any person, or attempts to do so, with intent to—
(A) influence, delay, or prevent the testimony of any person in an official proceeding;
(B) cause or induce any person to—
(i) withhold testimony, or withhold a record, document, or other object, from an official proceeding;
(ii) alter, destroy, mutilate, or conceal an object with intent to impair the integrity or availability of the object for use in an official proceeding;
(iii) evade legal process summoning that person to appear as a witness, or to produce a record, document, or other object, in an official proceeding; or
(iv) be absent from an official proceeding to which that person has been summoned by legal process; or
(C) hinder, delay, or prevent the communication to a law enforcement officer or judge of the United States of information relating to the commission or possible commission of a Federal offense or a violation of conditions of probation, supervised release, parole, or release pending judicial proceedings;
shall be punished as provided in paragraph (3).
(3) The punishment for an offense under this subsection is—
(A) in the case of a killing, the punishment provided in sections 1111 and 1112;
(B) in the case of—
(i) an attempt to murder; or
(ii) the use or attempted use of physical force against any person;
imprisonment for not more than 30 years; and
(C) in the case of the threat of use of physical force against any person, imprisonment for not more than 20 years.
(b) Whoever knowingly uses intimidation, threatens, or corruptly persuades another person, or attempts to do so, or engages in misleading conduct toward another person, with intent to—
(1) influence, delay, or prevent the testimony of any person in an official proceeding;
(2) cause or induce any person to—
(A) withhold testimony, or withhold a record, document, or other object, from an official proceeding;
(B) alter, destroy, mutilate, or conceal an object with intent to impair the object’s integrity or availability for use in an official proceeding;
(C) evade legal process summoning that person to appear as a witness, or to produce a record, document, or other object, in an official proceeding; or
(D) be absent from an official proceeding to which such person has been summoned by legal process; or
(3) hinder, delay, or prevent the communication to a law enforcement officer or judge of the United States of information relating to the commission or possible commission of a Federal offense or a violation of conditions of probation [1] supervised release,, [1] parole, or release pending judicial proceedings;
shall be fined under this title or imprisoned not more than 20 years, or both.
(c) Whoever corruptly—
(1) alters, destroys, mutilates, or conceals a record, document, or other object, or attempts to do so, with the intent to impair the object’s integrity or availability for use in an official proceeding; or
(2) otherwise obstructs, influences, or impedes any official proceeding, or attempts to do so,
shall be fined under this title or imprisoned not more than 20 years, or both.
(d) Whoever intentionally harasses another person and thereby hinders, delays, prevents, or dissuades any person from—
(1) attending or testifying in an official proceeding;
(2) reporting to a law enforcement officer or judge of the United States the commission or possible commission of a Federal offense or a violation of conditions of probation [1] supervised release,, [1] parole, or release pending judicial proceedings;
(3) arresting or seeking the arrest of another person in connection with a Federal offense; or
(4) causing a criminal prosecution, or a parole or probation revocation proceeding, to be sought or instituted, or assisting in such prosecution or proceeding;
or attempts to do so, shall be fined under this title or imprisoned not more than 3 years, or both.
(e) In a prosecution for an offense under this section, it is an affirmative defense, as to which the defendant has the burden of proof by a preponderance of the evidence, that the conduct consisted solely of lawful conduct and that the defendant’s sole intention was to encourage, induce, or cause the other person to testify truthfully.
(f) For the purposes of this section—
(1) an official proceeding need not be pending or about to be instituted at the time of the offense; and
(2) the testimony, or the record, document, or other object need not be admissible in evidence or free of a claim of privilege.
(g) In a prosecution for an offense under this section, no state of mind need be proved with respect to the circumstance—
(1) that the official proceeding before a judge, court, magistrate judge, grand jury, or government agency is before a judge or court of the United States, a United States magistrate judge, a bankruptcy judge, a Federal grand jury, or a Federal Government agency; or
(2) that the judge is a judge of the United States or that the law enforcement officer is an officer or employee of the Federal Government or a person authorized to act for or on behalf of the Federal Government or serving the Federal Government as an adviser or consultant.
(h) There is extraterritorial Federal jurisdiction over an offense under this section.
(i) A prosecution under this section or section 1503 may be brought in the district in which the official proceeding (whether or not pending or about to be instituted) was intended to be affected or in the district in which the conduct constituting the alleged offense occurred.
(j) If the offense under this section occurs in connection with a trial of a criminal case, the maximum term of imprisonment which may be imposed for the offense shall be the higher of that otherwise provided by law or the maximum term that could have been imposed for any offense charged in such case.
(k) Whoever conspires to commit any offense under this section shall be subject to the same penalties as those prescribed for the offense the commission of which was the object of the conspiracy.

It has almost been a year at this point and the father has yet to have been heard or his witnesses. The father then subpoenaed Attorney Scarlett Davidson to the court house for a deposition under oath about all the fraudulent actions she had committed including fabricating evidence. Attorney Scarlett Davidson had the father arrested 1 hour before she was supposed to attend the deposition.

However it did not stop there as Attorney Scarlett Davidson then amended her petition to terminate the father’s parental rights for her client Yvonne Howard due to him being arrested at her request. That is correct she asked the court to terminate his parental rights for being in a county jail waiting to go to court due to her, the Attorney on the case for Yvonne Howard, having the father arrested.

Pattern and Practice falls under Title 42, U.S.C., Section 14141. This civil statute was a provision within the Crime Control Act of 1994 and makes it unlawful for any governmental authority, or agent thereof, or any person acting on behalf of a governmental authority, to engage in a pattern or practice of conduct by law enforcement officers or by officials or employees of any governmental agency with responsibility for the administration of juvenile justice or the incarceration of juveniles that deprives persons of rights, privileges, or immunities secured or protected by the Constitution or laws of the United States.

Whenever the Attorney General has reasonable cause to believe that a violation has occurred, the Attorney General, for or in the name of the United States, may in a civil action obtain appropriate equitable and declaratory relief to eliminate the pattern or practice.

Types of misconduct covered include, among other things:
1. Excessive Force
2. Discriminatory Harassment
3. False Arrest
4. Coercive Sexual Conduct
5. Unlawful Stops, Searches, or Arrests

The father obtained a certified copy of Attorney Scarlett Davidson being cross examined by him. That transcript shows Attorney Scarlett Davidson testifying to witness tampering and perjury. Furthermore another document received from the Florida bar by the father was Attorney Scarlett Davidson’s response to his complaint. In that response Scarlett Davidson stated to the Florida Bar no one was trying to adopt the child and that no adoption petition was ever filed.

Strangely enough, Judge John Dean Moxley Jr., who’s previous reckless actions resulted in Alissa Blanton’s death, refused to notice in his adoption proceedings that the petitioner’s attorney told the Florida Bar she had not filed for an adoption while she was requesting an adoption plan. Judge Moxley was given a copy of those documents months before hand and set a hearing on it as if it was humorous to him. Judge Moxley then acted under color of law to prevent having a hearing on that too. This is concealing evidence with knowledge.

The father sent videos of some of the events as links in correspondence to the White House about the adoption fraud and Title IV Funding fraud. Days later the President of the United States of America issued this proclamation specifically pointing out due process and Title IV.

On the 15th of May in 2010 Yvonne Howard abducted the child of 2 parents. The child was hidden for over a half a month. Yvonne Howard then filed a petition for a fraudulent private adoption with the aid of Attorney Scarlett Davidson, a partner in Culmer & Davidson P.A. Yvonne Howard lives at 2203 Greenway Drive in Melbourne Florida. She swore under oath she did not know where the parents were. However, it doesn’t take much more than common sense to know she committed perjury. This family was happy until Yvonne Howard was knowingly allowed to perjure belligerently to the court and defy any court orders without the parents having any recourse. It would appear victimizing victims is entertaining to Judge Moxley as whe the victims express their concerns all he does is grin and advocate for the offenders to continue victimizing.

Facts:

Yvonne took the child from school never to return on May 5th in 2010 violating Florida Statutes.

The child was hidden never to return to school.

On May 21st she showed up in court, still holding the child for ransom, and stated she had no problems with the father after kidnapping the child and hiding her from him.

On May 21st she also testified she did in fact know her daughter, the mother, lived with her stepfather, Bill Howard, a few blocks away.

This is not the only conflicting statements she made and in fact Attorney Scarlett Davidson Davidson requested if she could testifyfor Yvonne Howard. The fraud didn’t stop there as Attorney Scarlett Davidson being told she couldn’t Testify for Yvonne Howard proceeded to fabricating evidence and witness tampering to say the least. This is not the first time Attorney Scarlett Davidson offered false facts and evidence to the court in a suit she previously represented the case was transferred to Federal Court. Attorney Scarlett Davidson was warned by the Federal Court she could not present herself as a Federal Attorney as she wasn’t licensed to practice in Federal Court.

Attorney Scarelett Davidson also told the Florida Bar no one was trying to adopt the child despite her client kidnapping the child and filing for a private adoption. What is a private adoption? It is when a private individual files for an adoption without the department of Children and Families. You heard that right, the Department of Children and families reported no abuse, abandonment or neglect was found.

However, the child found as fact to be hidden and prevented contact with her parents by Yvonne Howard was later baker acted and reported that Yvonne Howard was threatening to break her fingers while pulling the 11 year old’s hair. Scarlett Davidson then simulated legal process to stop trial before the defense could present their evidence violating due process, Constitutional Rights and Federal Laws.

Although Attorney Scarlett Davidson lied to multiple Judges, also being called out on it by Attorney Ashley Severance, she also lied to the Florida Bar. Judge Moxley was made aware of it and ignored the perjury, fabricating evidence and the tampering with witnesses by both Attorney and client. It appears Judge Moxley sits on a bench of injustice victimizing victims and certifying his approval of murder, sex offenses, abduction and child abuse. Just listen to the 911 tape of the murder here due to Judge Moxley’s wild and reckless actions with concealing evidence and abuses of discretion.

Let us review one of the many Florida Bar Rules Attorney Scarlett Davidson has broken multiple times:

RULE 4-3.3 CANDOR TOWARD THE TRIBUNAL

(a) False Evidence; Duty to Disclose. A lawyer shall not knowingly:

(1) make a false statement of fact or law to a tribunal or fail to correct a false statement of material fact or law previously made to the tribunal by the lawyer;

(2) fail to disclose a material fact to a tribunal when disclosure is necessary to avoid assisting a criminal or fraudulent act by the client;

(3) fail to disclose to the tribunal legal authority in the controlling jurisdiction known to the lawyer to be directly adverse to the position of the client and not disclosed by opposing counsel; or

(4) offer evidence that the lawyer knows to be false. A lawyer may not offer testimony that the lawyer knows to be false in the form of a narrative unless so ordered by the tribunal. If a lawyer, the lawyer’s client, or a witness called by the lawyer has offered material evidence and the lawyer comes to know of its falsity, the lawyer shall take reasonable remedial measures including, if necessary, disclosure to the tribunal. A lawyer may refuse to offer evidence that the lawyer reasonably believes is false.
(b) Criminal or Fraudulent Conduct. A lawyer who represents a client in an adjudicative proceeding and who knows that a person intends to engage, is engaging, or has engaged in criminal or fraudulent conduct related to the proceeding shall take reasonable remedial measures, including, if necessary, disclosure to the tribunal.

(c) Ex Parte Proceedings. In an ex parte proceeding a lawyer shall inform the tribunal of all material facts known to the lawyer that will enable the tribunal to make an informed decision, whether or not the facts are adverse.

(d) Extent of Lawyer‘s Duties. The duties stated in this rule continue beyond the conclusion of the proceeding and apply even if compliance requires disclosure of information otherwise protected by rule 4-1.6.

The child was sexually touched while inadequately supervised by Yvonne Howard and Judge Moxley ignored that too. Greed is no excuse for destroying children and what will the Judge say this time? Is he not omniscient again as he stated to the Orlando Sentinel previously without any remorse? Is he being paid off for his fraud resulting in funding fraud?
